El objetivo de este artículo es identificar las consideraciones de quienes deben guiar la sanción o reforma de la ley penal. Este objetivo cobra relevancia si consideramos que las diferentes respuestas pueden impactar en las tasas de cumplimiento del derecho penal y en los niveles de coacción estatal arbitraria. Para ello, se analizarán algunas propuestas teóricas que se ubican en una cuyos extremos están ocupados, respectivamente, por el populismo y el elitismo penal. Estos argumentos son reconstruidos en el debate sobre (...) la reforma del Código Penal Argentino. En este debate, la disminución de la interferencia proveniente del delito y la disminución de la interferencia estatal arbitraria se presentan como objetivos incompatibles. En parte, ello se debe a que las propuestas teóricas que alimentan los argumentos del debate presentan algunas limitaciones para satisfacer ambas demandas. El republicanismo, a través de la defensa de una democracia deliberativa fuerte, tiene capacidad para satisfacer ambas demandas, aparentemente antagónicas. Sin embargo, esa capacidad se ve disminuida en sociedades desiguales. Por ello defenderé que una reforma guiada por aquella propuesta republicana tiene una capacidad que se limita a disminuir la interferencia estatal y mantener iguales los índices de delito. (shrink)

A supertask is a process in which an infinite number of individuated actions are performed in a finite time. A Newtonian supertask is one that obeys Newton''s laws of motion. Such supertasks can violate energy and momentum conservation and can exhibit indeterministic behavior. Perez Laraudogoitia, who proposed several Newtonian supertasks, uses a local, i.e., particle-by-particle, analysis to obtain these and other paradoxical properties of Newtonian supertasks. Alper and Bridger use a global analysis, embedding the system of particles in a (...) Banach space, to determine the origin of the strange behavior. This paper provides a common framework for the discussion of both the local and global methods of analysis. Using this single framework, the areas of disagreement and agreement are made explicit. Further examples of supertasks are proposed to illuminate various aspects of the discussion. (shrink)

We argue that the later Wittgenstein’s philosophy of language and mathematics, substantially focused on rule-following, is relevant to understand and improve on the Artificial Intelligence (AI) alignment problem: his discussions on the categories that influence alignment between humans can inform about the categories that should be controlled to improve on the alignment problem when creating large data sets to be used by supervised and unsupervised learning algorithms, as well as when introducing hard coded guardrails for AI models. We cast these (...) considerations in a model of human–human and human–machine alignment and sketch basic alignment strategies based on these categories and further reflections on rule-following like the notion of meaning as use. To sustain the validity of these considerations, we also show that successful techniques employed by AI safety researchers to better align new AI systems with our human goals are congruent with the stipulations that we derive from the later Wittgenstein’s philosophy. However, their application may benefit from the added specificities and stipulations of our framework: it extends on the current efforts and provides further, specific AI alignment techniques. Thus, we argue that the categories of the model and the core alignment strategies presented in this work can inform further AI alignment techniques. (shrink)

In this paper a simple model in particle dynamics of a well-known supertask is constructed (the supertask was introduced by Max Black some years ago). As a consequence, a new and simple result about creation ex nihilo of particles can be proved compatible with classical dynamics. This result cannot be avoided by imposing boundary conditions at spatial infinity, and therefore is really new in the literature. In this chapter, we will summarize recent empirical results highlighting how different groups of people solve pure coordination games. Such games are traditionally studied in behavioural economics, where two people need to coordinate without communicating with each other. Our results suggest that coordination choices vary across groups of people, and that people can adapt flexibly to these differences in order to coordinate between groups. We propose that pure coordination games are a useful empirical platform for studying aspects of mindshaping. Drawing (...) on existing psychological literature on alignment during interactions, we suggest that experience of successful interaction leads people to develop aligned intuitions about what is relevant and appropriate that support coordination when interaction and communication is not possible. Consistent with arguments made in the literature on mindshaping we believe that such alignment is more important for coordination than mindreading inferences about mental states, and indeed that mindreading is instead a form of coordination behaviour that is dependent upon intuitive alignment. In Belgium, a service voucher scheme – known as Titres Services – was launched in 2004 in order to create employment and regularize the labor conditions of domestic workers. The extent to which this scheme has represented an improvement in domestic workers’ labor conditions, however, is still a matter of debate. This article explores the workers’ experience of the changes introduced by this scheme. It focuses on Latin American migrants that are currently working under this scheme in Brussels, situating them (...) in relation to their previous experiences and the experience of other migrants who currently work in the informal market. The authors distinguish two tropes in their informants’ discourse, which describe their ambivalence regarding these changes. Using the Titres Services scheme’s rhetoric, the first one seeks to increase the social status of this occupation by presenting it as a ‘profession’. In our daily lives, we need to predict and understand others’ behavior in order to navigate through our social environment. Predictions concerning other humans’ behavior usually refer to their mental states, such as beliefs or intentions. Such a predictive strategy is called ‘adoption of the intentional stance.’ In this paper, we review literature related to the concept of intentional stance from the perspectives of philosophy, psychology, human development, culture, and human-robot interaction. We propose that adopting the intentional stance might be (...) a pivotal factor in facilitating social attunement with artificial agents. The paper first reviews the theoretical considerations regarding the intentional stance and examines literature related to the development of the intentional stance across life span. Subsequently, we discuss cultural norms as grounded in the intentional stance, and finally, we focus on the issue of adopting the intentional stance toward artificial agents, such as humanoid robots. At the dawn of the artificial intelligence era, the question of how – and also when – we predict and explain robots’ behavior by referring to mental states is of high interest. The paper concludes with a discussion on ethical consequences of adopting the intentional stance toward robots, and sketches future directions in research on this topic. (shrink)

Rodger et al have interestingly argued that xenotransplantation should, if possible, entail the use of genetic pain disenhancement to prevent otherwise unavoidable pain in ‘donor’ animals.1 Their argument relies on the empirical assumption that xenotransplantation offers a realistic solution to organ shortage, and that, due to the recent clinical developments and the lack of human donors, it will thus continue for the foreseeable future. We argue below that other options should be prioritised over xenotransplantation, and that so-called ‘non-sentientist’ harms are (...) undervalued in discussions on disenhancement. We do not challenge the empirical claim made by the authors. That is, xenotransplantation research might continue for the foreseeable future since organ demand is increasing. However, we disagree with the priority given to xenotransplantation over other solutions that are more morally desirable. We argue that, if we comply with the 3R principles (Replacement, Reduction, and Refinement of the use of animals in research) and follow a minimal welfarist reasoning (to which the authors seem to adhere), then (1) the principle of replacement demands the use of non-animal alternatives if possible and (2) there are alternative solutions that lead to morally better consequences. Entre otras consideraciones, se constatará que la denominación “filosofía experimental” es parcialmente acertada, pero también parcialmente equívoca debido a dos razones. Una razón queda de manifiesto en discusiones contemporáneas que localizan antecedentes de ese enfoque en conexiones entre (...) la filosofía y las ciencias empíricas a través de los siglos. La segunda razón tiene mayor importancia; para identificarla será conveniente evaluar las funciones de la experimentación, tanto en las ciencias empíricas como en la filosofía. Sacrificial dilemmas such as the trolley problem play an important role in experimental philosophy (x-phi). But it is increasingly argued that, since we are not likely to encounter runaway trolleys in our daily life, the usefulness of such thought experiments for understanding moral judgments in more ecologically valid contexts may be limited. However, similar sacrificial dilemmas are experienced in real life by animal research decision makers. As part of their job, they must make decisions about the suffering, and often the (...) death, of many non-human animals. For this reason, a context-specific investigation of so-called “3R dilemmas” (i.e., dilemmas where there is a conflict between the principles of replacement, reduction, and refinement of the use of animals in research) is essential to improve the situation of both non-human animals and human stakeholders. An approach well suited for such investigation is experimental philosophical bioethics (“bioxphi”), which draws on methods similar to x-phi to probe more realistic, practical scenarios with an eye to informing normative debates and ethical policy. In this article, we argue for a need to investigate 3R dilemmas among professional decision-makers using the tools of bioxphi. In a first step, we define 3R dilemmas and discuss previous investigations of professionals’ attitudes in such cases. In a second step, we show how bioxphi is a promising method to investigate the whys and hows of professional decision-making in 3R dilemmas. In a last step, we provide a bioxphi template for 3R dilemmas, give recommendations on its use, explore the normative relevance of data collected by such means, and discuss important limitations. Trabajo que aborda, desde la perspectiva de la postsecularización, la realidad sociorreligiosa de Canarias, partiendo del estudio de la comunidad de practicantes de la Regla de Osha-Ifá. En esa línea, analiza cómo la visibilidad de los rituales y prácticas de esta religión en la esfera pública suponen un reto para el reconocimiento normativo de la pluralidad ¿Es la postsecularización un paradigma para una aproximación fructífera de las transformaciones sociorreligiosas que se dan en el contexto del archipiélago? En este sentido, se (...) busca reflexionar sobre el papel de las prácticas religiosas ligadas a la sanación y la medicina popular como un ámbito de conflicto entre la población local y estas comunidades. Conflicto del que se hacen eco los Medios de Comunicación tradicionales y las Redes Sociales digitales. Un universo que implica el uso de los recursos locales y se inserta en los debates sobre las relaciones ecológicas, interespecies y la espiritualidad. Se busca estudiar este proceso en constante movimiento, donde modernidad y religiosidad conviven y se nutren. Para ello, tanto la perspectiva procesual, donde la performatividad se convierte en el foco del análisis, como el planteamiento de la postsecularización y su necesidad de un diálogo entre lo teórico y lo empírico, permitirían avanzar en investigaciones capaces de un reconocimiento de otras formas contemporáneas de vivir y pesar lo sagrado y lo espiritual. The primary goal of this article is to analyze the main features that characterize this specialty, according to the sense in which the label began to be used. Among other considerations, we will see that the description "experimental philosophy" is partially correct, but also partially wrong, due to two reasons. The first can be tracked in contemporary discussions that locate antecedents of that approach in connections between philosophy and the empirical sciences through the centuries. To identify the second, more important reason, it will be convenient to evaluate the functions of experimentation, both in the empirical sciences and in philosophy. A este respecto, hechos como su valoración positiva de la desigualdad social o su desatención del desarrollo económico de los pueblos, me llevan a concluir que Rawls mantiene un posicionamiento conservador en lo que respecta a problemas como la pobreza o el desarrollo global.

The expressivist account of knowledge attributions, while claiming that these attributions are nonfactual, also typically holds that they retain a factual component. This factual component involves the attribution of a belief. The aim of this work is to show that considerations analogous to those motivating an expressivist account of knowledge attributions can be applied to belief attributions. As a consequence, we claim that expressivists should not treat the so-called factual component as such. The phenomenon we focus on to claim that (...) belief attributions are non-factual is that of normative doxastic disagreement. We show through several examples that this kind of disagreement is analogous to that of the epistemic kind. The result will be a doxastic expressivism. La competencia léxica como parte de la competencia comunicativa contempla una serie de elementos entre los cuales el dominio de la valencia léxica constituye uno de los factores que permite distinguir los hablantes nativos de un idioma de aquellas personas que lo estudian como idioma extranjero o segunda lengua. Este artículo expone algunas consideraciones metodológicas para la implementación de un folleto sobre valencia léxica en Inglés con Fines Médicos para el perfeccionamiento del tecnolecto de los estudiantes de 5to año de (...) la carrera de Medicina, elaborado a partir de las necesidades cognoscitivas expresadas por parte de alumnos y profesores. El folleto facilita la adquisición y práctica de términos que enriquecen el tecnolecto; de esta forma se contribuye a un aprendizaje contextualizado, rápido y más eficaz por parte de los estudiantes. Además del carácter práctico de la propuesta, su fundamentación teórica puede servir de referencia para la elaboración de otros folletos. Lexical competence, as part of communicative competence, takes into account a series of elements among which mastering lexical valence is one of the factors allowing to distinguish native language speakers from people who study a foreign or a second language. The article presents methodological considerations for the implementation of a booklet on lexical valence in English for Medical Purposes which, developed from students and professors' cognitive needs, aims to improve fifth year medical students' technolect. It makes terms enriching technolect easier to practice and to acquire; therefore contributing to a contextualized, fast and more efficient learning by students. Apart from the practical character of the proposal, its theoretical basis can be used as reference for the development of other booklets. (shrink)

This study employed a technology surveillance process in the beekeeping sector with the objective of identifying emerging technologies that are relevant to small beekeepers in emerging economies. The analysis of patents classified under A01K 47/00 revealed the emergence of pivotal innovations in domains such as hive design, automated honey extraction, and the integration of sensors for hive monitoring. The surveillance process facilitated the collection and analysis of data on the most patented technologies in the sector, thereby addressing key planning questions. (...) The study identified technological trends with the potential to transform beekeeping in low-tech contexts, thereby enhancing the productivity and sustainability of beekeeping operations. The findings of this study indicate that the identified technologies have the potential to significantly contribute to the well-being of small beekeepers, provided that their adoption is facilitated through the provision of governmental and organizational support. It is recommended that future research investigate the implementation of these technologies and the factors that influence their adoption in diverse production contexts. (shrink)

Desde un recorrido por algunas de las transformaciones desarrolladas en la práctica religiosa cotidiana de distintas comunidades, producidas en los meses iniciales de la pandemia del COVID 19, se abordaron las respuestas de estas comunidades religiosas, mediadas por las Tics. La investigación tenía el objetivo de profundizar en los procesos de adaptación de los rituales y celebraciones religiosas, desde un acercamiento a los procesos de virtualización y digitalización. Asimismo, analizar el espacio que ocuparon los Mass Media en la formulación de (...) relatos sobre las prácticas religiosas en el contexto pandémico. Por último, comprender el papel que tuvieron las comunidades religiosas en la resolución de muchos de los conflictos e incertidumbres existenciales generadas durante ese período. En este sentido, quería dar respuesta a cuestiones cómo ¿Qué implicó la situación de Pandemia para las comunidades religiosas? ¿En qué medida podemos hablar de una redefinición de los espacios sagrados? ¿Qué lugar ocuparon las tecnologías a la hora de solventar las dificultades cultuales en las congregaciones religiosas? ¿Cuál fue el relato de los Mass Media sobre las prácticas de estas comunidades religiosas? Para dar respuesta a estas cuestiones se optó por la etnografía virtual de los espacios mediados por las Tics, y la realización de entrevistas para recoger las experiencias religiosas offline. Los resultados revelaron que la resiliencia mostrada por las personas de estas comunidades religiosas reflejaba su capacidad para reformular y redimensionar las prácticas religiosas, desde las herramientas digitales. In the last decades, the evidence-based approach has become dominant in the biomedical sciences. Its influence has extended from clinical practice to other areas such as drug regulation and public health. Nonetheless, given the limitations of the evidence-based framework, a more pluralist approach towards evidence has been demanded. In this sense, evidential pluralism holds that evidence of mechanisms should complement statistical evidence. This paper aims to explore and discuss the prospects of evidential pluralism in public health. First, we will analyse (...) the evidential standards of the International Agency for Research on Cancer. Those standards are argued to be in line with the pluralist approach. Second, we will consider the main challenges for gathering evidence of mechanisms in public health. For that purpose, diverse types of evidence of mechanisms will be identified. And third, we will assess the role of agent-based models as mechanistic studies. Based on a case study, we will discuss whether agent-based models can provide evidence of mechanisms and mitigate the abovementioned challenges. (shrink)

This particular rally was led by fierce student and community organizers and workers who loudly proclaimed their opposition to President Rodrigo Duterte’s misogynistic and fascist measures. Song written by Charmaine Balisalisa. 490 Anna Romina Guevarra and Maya Arcilla above captures the lyrics of one young activist’s chant directed at Duterte and choreographed to the tune of Queen’s “We will Rock You.” People followed her steps and gestures rhythmically and in unison, accompanying her chant with sounds from a gangsa (gong), bells, a skateboard tapping the ground, and an empty bucket. There have been multiple protests denouncing Duterte since he assumed power in 2016, but on this particular day, the sense of outrage and urgency was especially palpable in the face of this new law aimed at suppressing dissent. This legislation marked a high point in Duterte’s efforts to exert authoritarian control, and it is significant that opposition to his regime has taken on a specifically feminist character. The Philippines Anti-Terrorism Act of 2020 (Republic Act No. 11479), signed into law on July 3, 2020, amends the Philippines Human Security Act of 2007 by expanding the government’s power and scope for defining what constitutes “terrorism.” It consolidates power through the creation of an Anti-Terrorism Council (ATC) appointed by the President and empowered to act without oversight from the judiciary or legislature. The ATC can order mass arrests without warrants and detain individuals without due process for the mere suspicion of being involved in “terrorist” activities. This Law violates the Philippine Constitution’s Bill of Rights by eliminating free speech, violating the people’s right to privacy, and criminalizing individuals on suspicion of wrongdoing. As the law stipulates, anyone involved in “creating an atmosphere and spreading a message of fear” and “provoking or influencing by intimidation the government or any of its international organizations” will be construed as inciting terrorism. Indeed, this law will continue to erode democratic governance in the country, with some labeling it a “stealth declaration of martial law.”3 As US Congressional Representative Jan Schakowsky (D-IL) noted at the press conference she convened on July 15 to publicly call for the Anti-Terrorism Law’s repeal, “this law represents a new weapon in the administration’s campaign to suppress dissent and will worsen attacks on ordinary people.” 3. This paper has two aims. First, we argue that Wittgenstein’s notion of petrification can be used to explain phenomena in advanced mathematics, sometimes better than more popular views on mathematics, such as formalism, even though petrification usually suffers from a diet of examples of a very basic nature (in particular a focus on addition of small numbers). Second, we analyse current disagreements on the absolute undecidability of CH under the notion of petrification and hinge epistemology. We argue that in contemporary (...) set theory the usage of construction techniques for set-theoretic models in which the Continuum Hypothesis holds and those in which it fails have petrified into the normative demand that CH remain undecidable. That is, the continuous and successful practices involving the construction of various set-theoretic models now act as a normative hinge shared among practitioners, i.e., have normative force in the discipline. However, not all hinges are universal, which is why we find disagreements in set theory. We will show that this is a refinement of, and partially conflicts with, the arguments presented by set theorist Joel David Hamkins. (shrink)
